CONDITIONS OF HIRE & PAYMENT TERMS

 

1) Application

These conditions apply whether a contract has been made verbally or in writing.
The hirer acts on behalf of all the passengers travelling on the vehicles. If the hirer is a company, group, or partnership, an individual must be named as a responsible person.
The hirer is responsible for the actions and decisions of all the passengers on board including any additional costs incurred in performing the contract, whether or not they actually travel with the party.
If the hirer is not going to travel with the party, a representative must be chosen, and the company informed prior the hire taking place. The company will only accept instruction form the hirer or their representative.

Where a copy of these conditions has been given to the hirer at any time, or the hirer has been advised verbally or in writing on their quotation documents of the terms, making a booking will be deemed to signify acceptance of them. Where a hirer makes a booking before receiving these conditions and without being advised verbally of all significant terms, the hirer may cancel the contract without liability to the operator within 24 hours of receiving these conditions. Otherwise, the hirer will be deemed to accept these conditions.

 

2) Quotations

Our quotations and prices are valid for 3 days from the date issued and is subject to availability at the time of actual booking.

We do not hire coaches to people under the age of 21. We will not allow a coach to be hired on behalf of passengers under the age of 21 unless an adult accompanies them. No animals (other than guide dogs and service dogs notified to the company in advance) maybe carried on any vehicle.

 

3) Booking Deposit

If you would like to go ahead and make a reservation, we would require a Euro 50 non-refundable booking deposit, per day, per vehicle. This must be paid at the time of booking in order to confirm your reservation. This can be paid by Visa or MasterCard or Bank Transfer.

 

4) Coach Hire Confirmation

When your booking deposit is paid, we will issue you with a reservation confirmation. You will receive the following:

A Reservation Number and Confirmation, this will list all coach hire details, hire charges and additional costs (coach parking, road tolls, driver’s expenses etc)
An invoice
A statement showing any booking deposit paid and outstanding balance
5) Payment (Non-account holders)

Full payment is required to reach us no later than 7 days in advance of your hire date. If payment is not received, we will cancel your reservation and retain your deposit.

 

6) Seating Capacity

Not more than the maximum number of passengers indicated at the time of booking may be carried on each vehicle.

The hirer must not load the vehicle beyond this capacity.

 

7) Use of the Vehicle

Unless previously agreed by the Company, the vehicle is not available for the use of the Hirer other than for journeys and times stated. The hirer cannot assume the use of the vehicle between outward and return journeys, not that it will remain at the destination for the hirer’s use unless this has been agreed with the company in advance and confirmed in writing.

 

8) Change of Vehicle

The Company reserves the right to provide a larger vehicle than the specified but at no additional charge unless any extra seats are used. The Company reserves the right to substitute other vehicles of similar quality including those of other operators, for all or part of the hiring.

The Company gives its advice on journey times in good faith but does not guarantee the completion of any journey at a specific time and will not be liable for loss or inconvenience caused by breakdown, extreme weather conditionals or traffic congestion, or other events beyond the reasonable control of the company. Journeys may take longer than predicted and in those circumstances the company will not be liable for any loss or inconvenience suffered by the hirer as a result.

 

9) Route and Time Variation

Should a vehicle be detained by the Hirer or taken on a longer journey than contracted journey for, the Company reserves the right to make an additional charge commensurate with the costs incurred. During the hiring, the driver must be the judge of any request for a

change of route or time. In any event, when the vehicle(s) depart at the agreed time the Company will not be liable for any loss or injury sustained by a passenger failing to join the vehicle at the appointed time.

 

10) Driver’s Hours and Rest Periods

The hours agreed with the Company for the operation of any hire(s) must be observed (other than in the case of serious emergency or diversion) so that current regulations governing driver’s hours and rest periods may be complied with. The company reserves the right to curtail or otherwise alter any hire, which does not comply with the relevant regulations.

 

11) Driver’s Working/Rest Period Regulations

The Hirer undertakes to abide by all statutory requirements and regulations which may in any way affect the journey in question and especially the regulations in respect of Driver’s Hours. Drivers are familiar with these regulations and whilst they will conform with reasonable requests of passengers (as to the reasonableness of which the driver alone shall be the judge) they will as far as circumstances permit, depart from the destination or from intermediate stopping places at times agreed beforehand (or specified by the driver) and to ensure compliance with the regulations will on no account wait for members of the party who may have failed to join the vehicle at the time appointed. The Company declines liability for loss, inconvenience or damage arising from failure to convey any such member of the party.

 

12) The Departure Time – Point to Point Travel

The departure time given by you is what we have quoted for. Normally the coach arrives 10 minutes prior to the departure time. In the event of any delay on your party, group or guests, then a ‘Stand-by’ surcharge of Euro 50 per hour or part thereof will be charged to your credit card.

 

13) Airport Transfers

If you have requested an Airport pick up, your coach will be in the Airport Coach Park 40 minutes after your scheduled landing time. If for any reason your group is delayed, please contact your driver, otherwise the ‘Stand-by’ fee will be applied.

 

14) Passengers’ Property

Unless previously agreed with the Company, the driver has discretion as to carriage of passengers’ luggage and its storage.

Pierce Kavanagh Coaches and our suppliers shall not be liable for any loss of damage to baggage or any of the guest’s belongings.

The Company will not accept liability for any damage to or loss of any property, which belongs to the passengers and is left in a vehicle. It is particularly drawn to the Hirer’s notice that theft from parked coaches is on the increase, and no items should be left on seats or in racks when the coach is unattended.

Guests should report any lost or damaged items to the Driver / Tour Director who will assist in completing a lost property form that may be used for any insurance claim in this matter.

All articles of lost property recovered from a vehicle will be held at our garage in Urlingford for a period of 14 days. All vehicles hired are subject to restrictions on carrying luggage for statuary safely reasons. The hirer accepts that the driver shall be the sole judge as to whether and to what extent passengers’ property is carried. Large ‘bulky’ items may not be able to be carried, and the hirer should take all steps to notify the company in advance of such requirements.

No bill, poster or notice is to be displayed on any vehicle without written consent of the company.

 

15) Damage to Coach

You are liable for any damage to the coach.

You are liable for any cleaning charges resulting in the improper behaviour of the passengers while onboard our coaches.

We respectfully ask our passengers to ensure that all rubbish is placed in rubbish bags, which are available on-board.

Cleaning on the vehicle as a result of excess mess will incur and additional €250 cleaning fee, per incident. If a client soils a vehicle multiple occasions during the hire period, subsequent changes will apply up to €1000.

 

16) Toilets / WC onboard

Many of our coaches have Toilets onboard. Please note that they are designed as emergency toilets only. They have the capacity for 10 liquid flushes only. If you are hiring the coach for longer than 1 day and require the toilet to be available for more than 10 flushes, an additional charge of Euro 45 may apply. This is the direct cost in approved facilities for emptying the unit.

 

17) Safety & Behaviour

It is imperative that the Hirer has familiarised themselves, understands and accepts our RISK ASSESSMENT POLICY.

All passengers must remain seated at all times, wear their seat belts (the law) and behave in a proper manner for the overall safety of all passengers.

When travelling with children, it is the responsibility of the adults / teachers / group leader to ensure these rules are adhered to and our risk assessment policy is followed.

Hot food and beverages are NOT permitted on our coaches under any circumstances, for the safety and comfort of our passengers and staff. We enforce a strict no smoking and no alcohol policy on board all our coaches.

PIERCE KAVANAGH COACHES do not employ medical personnel or offer any medical advice to passengers. If a passenger requires medical attention, it must be at the nearest facility at their own expense. PIERCE KAVANAGH COACHES are not responsible for any cost incurred due to quarantine, restrictions of limitation of travel, unavailability of medical services or any medical services obtained whilst travelling on our coaches.

Pierce Kavanagh Coaches reserve the right to remove or quarantine any passenger who shows signs of illness, or who poses a threat to the health and safety of the other passengers and our staff.  Removal or quarantine of passenger/s for any health, safety, or behavioural issues is at the discretion of the company.  All expenses incurred due to illness, isolation or quarantine are the sole responsibility of the passenger and their personal travel insurance.
Passengers will be allowed to re-join the coach with a confirmed medical certificate from a registered medical health practitioner stating that they are fit to travel without posing a risk to other passengers.

 

18) Conduct of Passengers

The driver is responsible for the safety of the vehicle. Any passengers whose conduct is in breach of statutory regulations may be removed on the driver’s authority. The Hirer will be held responsible for the conduct of passengers and for any damage caused to the vehicle by passengers during the hiring. The Company will not accept liability for damage or loss to any passenger walking around the coach, entering or leaving the coach whilst in motion. 19) Cancellation Policy

Your booking deposit is non-refundable.

-Cancellation by Hirer

In the event of cancellation by the Hirer, the Company reserves the right to retain any deposit. The Hirer shall be liable to the Company for any losses incurred by the Company as a result of the cancellation but not exceeding the full amount of the full cost of the hiring.

We require a minimum of 7 days cancellation notice prior to the commencement date of hire in order for no cancellation fees to be applied.
Cancellations received less than 7 days prior to the commencement date of hire will incur a 20% cancellation fee.
Cancellations received less than 72 hours prior to the commencement date of hire will incur a 50% cancellation fee.
Cancellations received on the day of hire will incur the full hire period charge.
No Shows will incur the full hire period charge.
All cancellations must be received by email. [email protected]

No refunds will be entertained unless you have a cancellation confirmation notice from us.

-Cancellation by The Company

In the event of any emergency or force majeure or of any action by the Hirer to vary the agreed conditions unilaterally, the Company may, by returning all monies paid and without further or other liability, cancel the contract.

 

20) Insurance

All Hirers and individual passengers are recommended to obtain insurance for those items, where save for the negligence, the Company’s liability is limited (such as delay or luggage).

Our quotation is based on the information you have supplied to us on the clients / your itinerary.
Any changes to this itinerary could result in a price amendment.
Your final itinerary will be checked by our staff to ensure that the legal EU Driving Regulations are taken into account.
